Hoschton appeals to high court on fee dispute
ATLANTA - The state Supreme Court heard Tuesday from lawyers explaining why the city of Hoschton should or shouldn't repay developers for a sewer pump it ordered them to install.

The debate came during oral arguments in the city's appeal of a decision by a Jackson County Superior Court judge that it must reimburse the developer $192,000 and pay the legal fees of the attorneys who won for the developers, Horizon Communities LLC.

Horizon had agreed to pay for the pump to provide sewer service to its Brook Glen subdivision, and in 2005 the city approved rezoning for the development in exchange.
Under the deal, the city would repay Horizon with lot-tap fees it received before June 6, 2010, but the city contends there haven't been any because real estate development petered out.
"I submit to you we would not be here today if the economy had not taken the downturn that it has taken," said Hoschton attorney Thomas Mitchell.
